Terms of Service

These terms are an agreement between you and NXT LVL AI, at nxtlvlai.app ("we", "us"). By creating an account or buying a plan you agree to them. If you are agreeing on behalf of a company, you confirm you may bind that company.
What the service does
NXT LVL AI measures how often and how favourably a website's brand appears in the answers of AI assistants. For a site you nominate, we build a set of prompts, ask them of several AI model families, and report what came back: visibility, share of voice, competitors named alongside you, the sources those answers cited, and how the wording about you reads.
The reports describe what AI models answered at the time they were asked. Those models change their answers over time and between users, and neither we nor anyone else controls them. We do not promise any particular visibility, ranking, traffic or commercial result, and nothing in a report is advice you should follow without your own judgement.
Accounts
You sign in with an email link. Keep access to that mailbox secure — anyone who can read it can reach your workspace. Tell us at [email protected] if you believe someone else has access. You must be at least 18 and must not use the service where doing so would breach the law that applies to you.
Plans, prices and what a purchase buys
Plans are bought per tracked site, not per user seat, and are listed on our pricing page. A One-time check is a single full run of the plan's prompt set. Tracking is a subscription that re-runs that same set automatically each week and keeps the trend, until you cancel; it is charged either monthly or once a year at a discount, and the weekly cadence is identical either way. Extra model families and extra languages are priced as listed and add to the total before you pay.
Prices are in US dollars and are calculated on our servers from the options you selected. Sales tax, VAT or GST is added where required and is shown before you confirm. We may change prices for future purchases and future renewals; a change never applies to a payment already taken.
A free check is offered for one site per workspace so you can see the product before paying. It is limited in scope, offered as-is, and we may change or withdraw it.
Payment and the merchant of record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
In practice: Paddle takes the payment, issues the invoice, charges the right sales tax for your country, and is the name that appears on your card statement. Buying from us also means accepting Paddle's buyer terms at checkout. Billing questions, invoices and refunds can go to Paddle directly or to us at [email protected] — we handle them either way.
Renewal and cancellation
A Tracking subscription renews on the date you bought it — every month, or every year on an annual plan — until you cancel. You can cancel at any time: the billing page has a cancel link that opens a message to us, or write to [email protected] directly. We act on it and confirm by email. Cancelling stops the next renewal and the site keeps running until the end of the period already paid for; on an annual plan you can also ask for the whole months you have not used back, as set out in the Refund Policy. A one-time check does not renew, so there is nothing to cancel.
If a renewal payment fails, we pause the site's automatic weekly runs and your reports stay readable while we try again. Refunds are covered by our Refund Policy.
How you may use it
Track sites you own or are authorised to work on — an agency tracking a client's site is exactly what the product is for. Do not use the service to break the law, to infringe someone's rights, to attack or overload our systems or anyone else's, to resell raw access to the underlying AI models, or to scrape or copy the service itself.
Fair use applies to the caps published on the pricing page. If usage on an account is far outside the plan it was sold under, we will contact you before doing anything about it.
Your content and your reports
You keep ownership of the site addresses, prompts and other material you give us. You grant us the licence we need to run the service on them: to crawl the public pages of the site you nominate, to send prompts to the AI providers listed in our Privacy Policy, and to store the resulting reports for you.
The reports we produce for you are yours to use, including with your clients. The service itself — the software, the prompt-building method, the measurement definitions and the interface — stays ours.
We may use aggregated, anonymised statistics that cannot identify you or your site to improve the product and to publish research.
Availability
We aim to keep the service up, but we do not guarantee uninterrupted availability. Runs depend on third-party AI providers; when one of them fails or rate-limits us, a run can be delayed or come back incomplete. When a check materially fails on our side, we re-run it or credit it — tell us and we will sort it out.
Liability
Nothing here excludes liability that cannot be excluded by law. Beyond that, the service is provided “as is”, and our total liability for any claim connected to it is limited to the amount you paid us in the three months before the claim arose. We are not liable for lost profits, lost revenue or indirect loss.
Suspension and termination
You can stop using the service and delete your workspace at any time. We may suspend or close an account that breaks these terms, or that we are legally required to close, and will tell you why unless the law prevents it. If we close your account without cause, we refund the unused part of any prepaid period.
Changes to these terms
We may update these terms. Material changes are announced by email or in the app before they take effect, and the date at the top of this page always shows the version in force. Continuing to use the service after that date means the new terms apply.
Governing law and contact
These terms are governed by the laws of United Arab Emirates, and its courts have jurisdiction over disputes, without affecting any consumer protection you have where you live.
